The Deutsche Gesellschaft für Internationale Zusammenarbeit (GIZ) GmbH is a global service provider in the field of international cooperation for sustainable development and international education work. After reassuming cooperation with Libya after 2015, GIZ is currently cooperating with Libya in the frame of seven projects. The “Governance Advisory Fund”, under which this service will be carried out, is designed to provide an open instrument to support different sector ministries and/or thematic committees under the Higher Committee for Transferring Competencies to Municipalities (HCTC) in the development of sectoral decentralization strategies and policy plans. As part of this activities, the Fund is aiming to support a legal assessment of the relevant laws that are relevant in view to decentralization policy.

In order to design a robust local administration system in the long run and build a functional efficient decentralized state and lay down solid foundation for the relationship between local and national level institutions; the Libyan government must first as an essential necessary step be supported in developing a legal "gap analysis" consolidated review process to ensure compatibility of its general laws and Local administration laws.

The objective of the assignment is to design a workplan to prepare a comprehensive activity to draft a Legal White book on decentralization reform. In this sense, the assignment that shall be carried out by an individual legal expert is meant to be a preparatory activity to define main challenges, relevant legislation and suitable (international) law firms for in depth analysis.

Hereby, the contractor is responsible for providing the following services:

Conduct interviews and focus group discussions with relevant stakeholders to identify gaps and legal constraints

Prepare a short list of relevant Libyan laws interacting with laws 59/2012 & 9/2013. (based on research and interviews)

Draft a decentralization legal framework gap analysis orientation document (based on research and interviews)

Draft a workplan for the process to elaborate a Legal White Book

Identify suitable law firms with the capacity to implement the Legal White Book development process.

Nonresponsive offers will not be considered.

Bidders must have a foreign currency bank account outside of Libya.

Payments will be in EUR currency to the contractor’s bank abroad.

GIZ cannot transfer money to Foreign Currency Accounts inside Libya

Financial Offers must contain the bidder’s bank details.

Bidders have to be registered in Libya and provide proof of this registration together with the offer.
